There are lot more activity awareness around intellectual property in both large and medium size companies. A couple of years back even large automotive companies and urban industrial houses did not really care much about protecting their intellectual property. Simultaneously the academic institutions are both aware and promoting IP creation. The corporations are realizing that they need to work more closely with the academic. They have to differentiate themselves in crowded educational market. Innovation and R&D cannot be built overnight. Firstly around monetary incentives, china’s number on monetary incentive for number of filling are high.
The top sector’s in India where we saw most of the patent activity are polymer and plastic, where 18% of filling has happened in the period of 2013-2015, Computing is number two at 17%, Pharmaceuticals is number three at 15%, Automobile is at seventh position at 7%.

GST is expected to accelerate the economy, but direct initiative from the government that will accelerate innovations and IP creations are things like incentive being offered via Start-Up India, all the broader initiatives under the Make in India umbrella like Avishkar Yojna or IMPRINT from MHRD. There is a need of increasing awareness from the start ups on IP than we would have historically and that should accelerate. The timeline are as I have said inherent in our Indian Practices, that whole of processes has lot of delay as compare to other IP offices around the world, as there government has hired far larger number of practices examiner than they had in the past.
The examiners need to have appropriate skills to examine packets. So especially if you are hiring the new examiners, you need to make sure that they are being trained properly. Secondly, they need to deploy technology to improve their operational efficiencies. So whenever an examiner does a search, they have to first look at the priorities and check if they are totally normal and repetitive. Also, you need automate lot of non essential tasks for using smart search technologies, for using more data mining to analyze the existing port of patent data.
Also the tech landscape moves very fast and one can’t expect the examiner to be an absolute expert on every area of technology. So we should take 3rd party help in understanding these technology areas proactively so that these examiners can be better informed.
