Hello and welcome to The Patkey Show where we discuss tips and tricks to qualify Indian Patent Agent examination conducted by Government of India. I am Cheshta Sharma.

And today we are going to pick up three questions which are asked by you and answer in our show. So let’s begin.

Kirtiman

Okay, so today’s first question is from the YouTube comments only. And the question is, Hi, Ma’am. I have completed my degree in 2020 March. And I have only consolidation Mark sheet and the provisional Mark sheet. I don’t have a degree certificate.

Cheshta

Okay.

Kirtiman

Can I use this consolidated Mark sheet instead of a degree certificate?

Cheshta

Yes, absolutely, dear. You can use your consolidated Mark sheet because consolidated Mark sheet, as you know, contains all the marks of all the semesters. So while filling up the form, you can upload this, your provisional Mark sheet and your consolidated Mark sheet, and also it will get passed. But yes, it is better that when you will qualify, when you will get your certificate, it’s better that by that time you try to arrange your degree from your University, that will be much, much better. But yes, consolidated Mark sheet on your provisional worksheet is good to go.

Okay. So I wanted to ask then on what date do I need to have this Marksheet? Is it on the date of the giving the examination? Is that the date?

Cheshta

No. When you will qualify the examination, that means there will be paper one, paper two, then there will be result of who qualified paper one and paper two, and there will be result of who has qualified for the Viva. Then there will be again result of final candidates who have become patent agent. And then again, you have to apply that you have passed the Indian Patent Agent examination and you have to apply for patent agent registration because you have qualified the paper at that time. You need a degree that will be tentatively around September October, not before that.

Kirtiman

All right. So do you understand this? There’s a marked distinction between the two events which are happening. One is that you are qualifying this examination. You are taking the examination paper one, paper two, and the YVA. And then the results are coming out. So this is one event I’m considering. And after this event is completed and your name has been, the result will come out and your name is there. So this event is over. Then the second event starts, which is then you have to apply for that. I have qualified then because there’s a fee.

Cheshta

Yes, there’s a fee. There’s a form number 27, which is there for applying of registration of a patent agent. And you apply through that, you have to pay the fees and then they will issue your certificate. At that time, they will actually verify your documents. And at that time, your all documents should be like intact. So you have time still to get your Marksheet still to get any document which is still at the provisional phase right now.

All right. Let’s move on to the next question. The second question is I am a pharmaceutical postgraduate with ten years of experience in pharmaceutical company. I’m 34 years of age. Can I pursue this course and do well in future or is it too late for me to do this now?

Cheshta

No, this is absolutely a good time because look, I have been talking in my videos, and when you qualify a patent agent examination, it is an addition to all the qualification, to all the degrees you already have. And it is good that you have experience in the pharmaceutical industry. Now, you can use this qualification. If you’re a formulation scientist, you can better design experiments. Can you know your rights as an inventor? And if you have this experience in pharmaceutical industry, you can help other people who are working in pharmaceutical industry to get their innovation register to help them. Coming from a pharmaceutical background, you will understand the intricacies about the industry. That how a drug formulation work, how a drug delivery works. And you can give them a very good advice. When you have a knowledge of patenting, you can combine these two knowledge, the knowledge of two fields, Pharma industry and patenting, and you will be a very good consultant. And it’s absolutely not late. It is absolutely a good thing that you’re still like 35 according to we are still young in your career. There’s like a lot more years for like go. And plus you can start your own consulting firm with this certificate and you have two years of experience.

And I’m sure you’ll get good national as well as international clients.

Kirtiman

Considering your experience, what I feel is that ten years of experience, in fact, does not make it too late. This makes even better impact that you have in depth knowledge of your core field, first of all. And then you have to understand that every industry, even though it is pharmaceutical and we are helping people by producing medicines, it’s commerce and patent comes under Ministry of Commerce. Right. So you becoming a patent agent and you have a ten year’s experience in this industry makes you an excellent candidate for promotion or probably high ranking jobs in your industry or the same company which you’re working right now also. So that increases your potential of getting jobs and promotions a lot. So ten years of experience is not too late. It’s very good, in fact. All right. Okay. So let’s move on to the third question. And third question is, do patent analysts need to qualify patent agent examination?

Okay. This question is coming once again, I think today. So I think last video also, we discussed that patent analyst and patent agents are two different job profiles. Right. It is absolutely not necessary that patent analysts should qualify patent agent examination of patient agent should know about patent analysts. They are two different job profiles that you have to understand and think that what type of work you really enjoy. So as a patent analyst, you work on creating Patentability Search, Freedom to Operate Search Patent Landscaping Technology Assessment Reports. This is a work of an analyst where you are analyzing a lot of patent data from a commercial viewpoint. Right.

Let’s make a complete video of Patent analyst. Also this being a Patent agent show, let’s do this topic some justice and we’ll make a complete video on patent analysis. And I’ll link it in the description below so that you can understand what does a patent analyst do? There also. But if you want to learn in short, in the last video of this show, you can see there’s a whole discussion on what is a patent analyst, patent officer and a patent agent and what are the differences of their works and all right, so we can go into that video if you want. But here’s the question. The question is do I need to qualify? So if I am a patent analyst already working like a KPO, Knowledge Processing, a BPU, the question is do I now need to qualify patent Agent Examination and if I do, what are the pros and cons? Should I even go for it?

Okay, so again, first of all, it’s not compulsory to become a patent agent. It is not just that after analyst you have to become agent. This is a career path. No. As a patent analyst, you can grow and have a very good package, maybe much above a patent agent. Now if you want to diversify your work, let’s say you have been patent analyst from five, six years and you want to change a little bit of your work and go into prosecution. You want to actually work with the patent office, then you can qualify patent Agent Examination. Or if you are thinking that after some time you want to start your own firm, start your own business, then I would say yes, you have a patent analyst experience of five years, let’s say working with a top company, CP or evaluation and then you qualify patent Agent Examination. Now, yes, you can start your own form, give your own consulting. Then it will be a good step. Now, you know the work of two things, analyst and agent and that will further include in your services which you will offer to your clients. Then it is a good step.

Then I would say yes, you should do that. But it’s not mandatory as a patent analyst. Also, people are earning much more better package than the agent. It’s not like that agent will earn more package. Analysts will earn less. No, absolutely not. Analysts working in top KPOs and top LPOs like Thompson Reuters, Clarivate, leaders over there. They work as an analyst for US and European Baselines and they have an excellent pay package.
